These Terms and Conditions (ā€œTermsā€, ā€œTerms and Conditionsā€ or ā€œAgreementā€) govern your access to and use of the website https://patlanistyle.in/ (ā€œWebsiteā€, ā€œSiteā€, ā€œPatlani Styleā€, ā€œweā€, ā€œusā€ or ā€œourā€), including all services, features, products and transactions made available through the Website.

The terms ā€œyouā€, ā€œyourā€, ā€œUserā€, ā€œCustomerā€, ā€œBuyerā€ or ā€œEnd Userā€ refer to any person accessing, browsing, registering on or purchasing products from the Website.

Patlani Style provides users with an online platform to browse and purchase clothing, apparel, ethnic wear, sarees, ready-to-wear sarees, lehenga sarees, lehengas, kurtis, co-ord sets, accessories and other products that may be offered on the Website from time to time (ā€œProductsā€ or ā€œGoodsā€).

By accessing the Website, creating an account, placing an order, making a payment or otherwise using any part of the Website, you acknowledge that you have read, understood and agreed to these Terms and Conditions together with our Privacy Policy, Shipping Policy, Cancellation Policy and Return/Refund Policy, wherever applicable.

If you do not agree with these Terms and Conditions, you should not access, use or purchase from the Website.

We reserve the right to modify, revise, update or replace any portion of these Terms at any time. Revised Terms will become effective when published on the Website unless otherwise stated. Your continued use of the Website after publication of any changes constitutes acceptance of the revised Terms.

You are advised to review these Terms periodically.

1. DESCRIPTION OF SERVICES

Patlani Style provides an online shopping platform through which customers may browse, select and purchase Products displayed on the Website at the prices and on the terms stated on the Website.

Product availability, styles, colours, sizes, designs, prices, offers and delivery availability may change from time to time.

We reserve the right to add, modify, suspend or discontinue any Product, collection, feature or service at any time without prior notice, subject to applicable law.

2. GENERAL CONDITIONS

By using this Website, you agree to use it only for lawful purposes and in accordance with these Terms.

Your right to use the Website is personal and may not be transferred to another person without our written permission.

We make reasonable efforts to keep the Website accessible and operational. However, uninterrupted or error-free availability cannot be guaranteed.

The Website may become temporarily unavailable because of:

  • maintenance;

  • server or hosting issues;

  • technical problems;

  • network failures;

By placing an order, you represent that you are legally capable of entering into the relevant transaction.

We reserve the right to refuse access, cancel an account or reject a transaction where we reasonably believe that a User is not legally eligible to enter into the transaction.

4. YOUR ACCOUNT

When creating or using an account, you agree to provide information that is true, accurate, current and complete.

You are responsible for keeping your login credentials, passwords and account information confidential.

You are responsible for activities carried out through your account unless such activity results from a security failure attributable to us.

We reserve the right to suspend or terminate an account where:

  • the account creates a security risk;

  • applicable law requires us to do so.

Unauthorized attempts to access restricted or password-protected portions of the Website are prohibited.

5. CUSTOMER INFORMATION

You agree that information supplied by you for an order must be accurate and complete.

You are responsible for ensuring that your shipping address, mobile number, email address, postcode and other order details are correct before completing your purchase.

Patlani Style will not be responsible for delivery delays or failed deliveries caused solely by incorrect or incomplete information supplied by the Customer.

6. USER CONDUCT AND PROHIBITED ACTIVITIES

You must not use the Website to upload, submit, communicate, transmit or otherwise make available material that:

  • belongs to another person and for which you do not have the necessary rights;

  • is unlawful, fraudulent, defamatory, threatening, abusive, obscene or otherwise prohibited by applicable law;

  • infringes any copyright, trademark, patent, privacy right or other proprietary right;

  • impersonates another person or business;

  • contains viruses, malware, malicious code or other harmful software;

  • attempts to obtain unauthorized access to our Website, server, database or systems;

  • interferes with the security or proper operation of the Website;

  • deceives or misleads users regarding the origin of a communication;

  • facilitates fraud, money laundering or other unlawful activity;

  • threatens public safety or violates applicable Indian law;

  • creates unreasonable liability or technical burden for Patlani Style.

We reserve the right to restrict Website access or remove content that violates these Terms or applicable law.

7. CUSTOMER REVIEWS, FEEDBACK AND CONTENT

If the Website allows customers to submit product reviews, images, comments, feedback or other content, you remain responsible for the content you submit.

By voluntarily submitting such content to Patlani Style, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt and publish that content for legitimate business, Website, marketing and promotional purposes, subject to applicable law and our Privacy Policy.

You must not submit content for which you do not have the necessary rights or permissions.

We reserve the right to moderate or remove reviews or other content that is unlawful, misleading, abusive, spam, irrelevant or otherwise violates these Terms.

8. EQUIPMENT AND INTERNET ACCESS

You are responsible for obtaining and maintaining the device, software, internet connection and other equipment required to access the Website.

You are responsible for any internet, mobile data or other charges associated with accessing the Website.

We are not responsible for damage to a User's device arising from circumstances outside our reasonable control.

9. PRODUCT INFORMATION

We make reasonable efforts to ensure that Product descriptions, photographs, measurements, colours, fabrics, embroidery details, specifications and other information displayed on the Website are accurate.

However, handmade products, embroidered products, printed fabrics, dyed fabrics and textile products may contain reasonable variations.

Minor variations may occur in:

  • colour;

  • print placement;

  • embroidery placement;

  • weave;

  • texture;

  • stitching;

  • embellishments;

  • measurements;

  • appearance.

Such minor differences arising from manufacturing, photography, screen display, lighting or the characteristics of textile products may not constitute a defect where they do not materially affect the Product.

10. COLOURS AND PRODUCT IMAGES

We make reasonable efforts to represent Product colours accurately.

However, the actual colour of a Product may vary slightly from what appears on your screen because of:

  • mobile or computer display settings;

  • brightness settings;

  • photography lighting;

  • studio or outdoor lighting;

  • screen calibration;

  • photographic processing; or

  • differences between individual fabric dye lots.

We therefore cannot guarantee that every device will reproduce a Product's colour with complete accuracy.

Product images are intended to help Customers understand the style and appearance of the Product.

Accessories, jewellery, footwear, styling items or props shown in images may be for presentation purposes only unless expressly included in the Product description.

11. SIZE AND MEASUREMENTS

Customers are responsible for reviewing the size chart, measurements and Product description before placing an order.

Measurements may vary slightly because of the nature of textile manufacturing, stitching and manual measurement.

Where a Product is described as ready-to-wear, fully stitched, semi-stitched, unstitched or adjustable, Customers should review the applicable Product description before purchasing.

Patlani Style will not be responsible for an incorrect size selected by the Customer, except to the extent that an exchange or return is permitted under our applicable Return/Exchange Policy.

12. ELECTRONIC COMMUNICATIONS

When you access the Website, create an account, place an order or contact us electronically, you consent to receive transactional communications from us electronically.

These communications may include:

  • order confirmations;

  • payment confirmations;

  • shipping information;

  • delivery updates;

  • cancellation information;

  • refund information;

  • account-related communications;

  • customer support communications;

  • important Website or policy notices.

We may also send marketing or promotional communications where permitted by law and based on your communication preferences or consent.

Where an unsubscribe facility is provided for marketing emails, you may use it to stop receiving promotional emails.

Transactional communications necessary to process an existing order may continue even if you opt out of promotional communications.

  • copy our product catalogue for commercial use;

  • use bots, crawlers or automated extraction tools without authorization;

  • frame the Website within another website;

  • use Patlani Style trademarks without permission;

  • attempt to bypass security measures;

  • interfere with Website functionality;

  • copy photographs, videos, descriptions or graphics for commercial purposes.

Any unauthorized commercial use may result in termination of your permission to access the Website and may also result in legal action where appropriate.

14. THIRD-PARTY LINKS AND SERVICES

The Website may contain links to third-party websites, payment gateways, courier services, social networks or other external services.

Such services are operated independently of Patlani Style.

We are not responsible for the content, availability, privacy practices, terms, security or performance of independent third-party websites or services.

Your use of a third-party website or service may be governed by that third party's own terms and policies.

15. PRODUCT AVAILABILITY

All Products displayed on the Website are subject to availability.

Adding a Product to your cart does not reserve that Product.

A Product may become unavailable before an order is successfully placed or processed.

We reserve the right to limit quantities, discontinue Products or cancel an order if the relevant Product becomes unavailable.

Where a prepaid order is cancelled because the Product is unavailable, the amount collected for that cancelled Product will be refunded in accordance with our refund process and applicable law.

16. PRICING

We make reasonable efforts to display accurate prices.

All Product prices are shown in Indian Rupees (INR) unless another currency is expressly stated.

Prices, discounts, promotions and availability may change from time to time.

The price applicable to your order will generally be the price displayed at the time the order is successfully placed, subject to correction of obvious errors.

Prices displayed on the Website are not intended as a representation that the same or similar Product cannot be available elsewhere at a different price.

17. PRICING OR TYPOGRAPHICAL ERRORS

Despite reasonable efforts, an incorrect price, discount, description or Product information may occasionally appear because of a technical, typographical or system error.

If an obvious pricing or Product information error is discovered after you place an order, we may:

  • contact you to inform you of the error;

  • request your confirmation at the correct price;

  • cancel the affected Product or order; or

  • take another reasonable action permitted by applicable law.

Where we cancel a prepaid order because of such an error, any payment collected for the cancelled Product will be refunded to the applicable payment method or through another legally permissible refund method.

18. TAXES AND BILLING

Product prices will include or exclude applicable taxes as displayed during checkout and as required by applicable law.

Any applicable GST, shipping charges, payment charges or other lawful charges will be disclosed where required before completion of the purchase.

The Customer is responsible for providing accurate billing information.

An invoice may be made available electronically or provided with the order, depending on the transaction and applicable legal requirements.

19. ORDERS

Placing an order on the Website constitutes an offer by you to purchase the selected Products subject to these Terms.

Receipt of an automated order confirmation does not necessarily mean that the order has been finally accepted or dispatched.

An order may be subject to:

  • payment authorization;

  • Product availability;

  • address verification;

  • fraud checks;

  • order verification;

  • quantity restrictions;

  • quality checks.

We reserve the right to refuse or cancel an order for legitimate reasons, subject to applicable law.

20. CANCELLATION BY PATLANI STYLE

We may cancel all or part of an order in circumstances including:

  • Product unavailability;

  • pricing errors;

  • incorrect Product information;

  • payment authorization failure;

  • suspected fraudulent activity;

  • inability to verify an order;

  • delivery restrictions;

  • quality control failure;

  • technical errors;

  • circumstances beyond our reasonable control.

If a prepaid order is cancelled by us, the amount received for the cancelled item(s) will be refunded in accordance with the applicable refund process.

We will make reasonable efforts to notify you using the email address or mobile number provided with your order.

21. CANCELLATION BY CUSTOMER

A Customer may request order cancellation by contacting Patlani Style at:

Cancellation requests should be submitted as early as possible after placing the order.

We may accept a cancellation request if the order has not already entered a stage where processing, customization, packing, dispatch or shipping cannot reasonably be stopped.

Where applicable, cancellation availability may also be displayed through the Customer's account or order page.

A cancellation request is not considered accepted until confirmed by Patlani Style.

If a prepaid order is successfully cancelled, the refundable amount will be processed according to our Refund/Cancellation Policy and applicable law.

Customized or personalized Products may not be cancellable once customization work has started.

22. RETURNS, EXCHANGES AND REFUNDS

Returns, exchanges and refunds are governed by the Return/Refund Policy published on the Website and applicable consumer law.

Customers should review the Product description and Return/Refund Policy before purchasing.

Different return eligibility conditions may apply to:

  • standard Products;

  • customized Products;

  • personalized Products;

  • made-to-order Products;

  • clearance Products;

  • promotional Products; or

  • Products sold under specific offers.

Nothing in these Terms is intended to exclude any mandatory consumer right available under applicable law.

23. FRAUDULENT OR DECLINED TRANSACTIONS

We may use reasonable verification and fraud-prevention measures to protect Customers and Patlani Style.

We reserve the right to reject, suspend or cancel transactions that we reasonably believe may involve:

  • stolen payment instruments;

  • unauthorized payment activity;

  • identity fraud;

  • false account information;

  • repeated abusive ordering behaviour;

  • misuse of coupons or promotions;

  • suspicious transaction patterns;

  • other unlawful activity.

Where legally appropriate, we may cooperate with payment providers, banks, law enforcement agencies and competent authorities.

We reserve the right to take appropriate legal action against fraudulent use of the Website.

24. PAYMENT DETAILS

Customers must use payment methods that they are legally authorized to use.

You agree that payment information supplied by you will be accurate and valid.

Payment transactions may be processed by independent banks, payment gateways or payment service providers.

Patlani Style does not require Customers to send complete card numbers, CVV numbers, OTPs, UPI PINs or banking passwords by email.

Never send your OTP, UPI PIN, CVV or banking password to patlanistyle.in@gmail.com or to anyone claiming to represent Patlani Style.

Payment authorization may be declined by a bank or payment service provider for reasons outside our control.

We will not be responsible for a payment provider or bank declining a transaction, except where applicable law provides otherwise.

25. CASH ON DELIVERY

Cash on Delivery (ā€œCODā€), where offered, is subject to:

  • serviceability of the delivery address;

  • order value limits;

  • Product eligibility;

  • verification requirements; and

  • our applicable COD policy.

We reserve the right to disable COD for particular Products, orders, locations or Customers where reasonably necessary to prevent misuse or operational problems.

Repeated refusal of genuine COD orders may result in restrictions on future COD availability.

26. SHIPPING AND DELIVERY

We will make reasonable efforts to process and dispatch orders within the estimated timeframe shown on the Website or communicated at the time of purchase.

Delivery times are estimates and may depend on:

  • shipping destination;

  • Product availability;

  • customization requirements;

  • courier performance;

  • weather;

  • festivals and public holidays;

  • transportation disruptions;

  • natural events;

  • government restrictions;

  • force majeure events;

  • other circumstances outside our reasonable control.

Estimated delivery periods are not guaranteed delivery dates unless expressly stated otherwise.

Patlani Style may use third-party courier or logistics providers for delivery.

27. DELIVERY ADDRESS

Customers are responsible for providing a complete and accurate delivery address.

The address should include, where applicable:

  • recipient name;

  • house/building information;

  • street or locality;

  • city;

  • state;

  • postcode/PIN code;

  • mobile number.

Additional shipping charges may apply if an order must be re-shipped because the Customer supplied an incorrect or incomplete address or failed to accept delivery, to the extent permitted by applicable law and our policies.

28. DELIVERY CONFIRMATION AND RESPONSIBILITY

Responsibility for Products will pass in accordance with applicable law and the delivery process.

Delivery records generated by the courier, including OTP confirmation, recipient acknowledgement, electronic proof of delivery or other reasonable delivery confirmation, may be used as evidence of delivery.

If you ask us or the courier to deliver an order to another person at your nominated address, delivery to that authorized recipient may constitute completion of delivery.

Customers should inspect packages after delivery and notify us promptly of any eligible issue in accordance with our Return/Refund Policy.

29. PARTIAL SHIPMENTS

Where an order contains multiple Products, we may ship them separately where reasonably necessary.

Each package may have a separate tracking number and may arrive at a different time.

A delay affecting one part of a multi-item order does not necessarily mean that all other parts of the order are cancelled.

30. UNDELIVERABLE OR REFUSED ORDERS

If a delivery cannot be completed because:

  • the Customer is unavailable;

  • the address is incorrect;

  • the Customer refuses the package;

  • required delivery verification cannot be completed;

  • repeated delivery attempts fail,

the package may be returned to us by the courier.

Any re-shipping, cancellation or refund resulting from such circumstances will be handled according to our applicable shipping, cancellation and refund policies and applicable law.

31. DELAYS BEYOND OUR CONTROL

Patlani Style is not responsible for delays caused solely by events outside our reasonable control, including delays attributable to courier companies, natural disasters, strikes, government restrictions, transport disruptions, extreme weather or other force majeure events.

Where a material delay occurs, we will make reasonable efforts to assist with tracking and resolution.

Nothing in this provision limits rights that cannot legally be excluded.

32. PRODUCT QUALITY AND DEFECTS

We endeavor to dispatch Products after reasonable quality checks.

If you receive a Product that is damaged, defective, materially incorrect or different from what was ordered, you should contact us within the period specified in our Return/Refund Policy and provide the requested information or evidence.

Eligible claims will be addressed according to our Return/Refund Policy and applicable law.

Normal characteristics of textile products, including minor thread variations, slight colour variations or reasonable measurement tolerances, may not necessarily constitute defects.

33. SALES, DISCOUNTS AND PROMOTIONAL OFFERS

From time to time, Patlani Style may offer:

  • discounts;

  • coupons;

  • promotional codes;

  • festival offers;

  • prepaid-order discounts;

  • flash sales;

  • clearance sales;

  • limited-time promotions;

  • cashback or store-credit offers.

Each offer may be subject to separate eligibility requirements, validity periods, Product restrictions and other conditions.

Unless otherwise stated:

  • offers cannot be exchanged for cash;

  • discount codes may not be combined;

  • offers may be limited to selected Products;

  • offers may be limited to one use per Customer;

  • offers may end when promotional stock is exhausted.

We reserve the right to withdraw, modify or discontinue promotional offers prospectively, subject to applicable law and without affecting confirmed orders where the offer has already been validly applied.

34. CASHBACK AND STORE CREDIT

Where Patlani Style specifically offers cashback or store credit, the terms displayed with that particular promotion will apply.

Unless the promotional terms state otherwise:

  • cashback may be issued as store credit;

  • cashback applies only to eligible Products or orders;

  • cancelled or refunded orders may not qualify;

  • cashback may be reversed when the underlying qualifying transaction is cancelled, returned or refunded;

  • cashback cannot ordinarily be transferred between customer accounts;

  • cashback has no cash value unless expressly stated otherwise;

  • expiry periods, if any, will be disclosed with the offer;

  • the amount may vary from Product to Product or promotion to promotion.

Where an offer promises a refund to the original payment method rather than store credit, that specific offer will prevail.

Patlani Style may modify or discontinue future cashback promotions without affecting cashback already validly earned, subject to the terms of the promotion and applicable law.

35. CUSTOMIZATION AND PERSONALIZED ORDERS

Patlani Style may offer customization on selected Products.

Customization may include, depending on the Product and availability:

  • measurement adjustments;

  • sleeve additions or alterations;

  • neckline adjustments;

  • lining or coverage modifications;

  • colour changes;

  • minor design adjustments;

  • other specifically accepted modifications.

Customization is subject to feasibility and availability.

Unless expressly agreed by Patlani Style, the basic silhouette or fundamental design of a Product cannot be changed.

Additional embroidery, embellishment or substantial modifications may involve extra charges.

Before placing a customized order, the Customer is responsible for supplying accurate measurements and customization instructions.

Once production or customization has begun, the order may not be cancellable.

Customized, personalized or made-to-measure Products may be non-returnable or non-exchangeable except where:

  • the Product is defective;

  • the Product is damaged;

  • the wrong Product was supplied;

  • the customization materially differs from specifications expressly accepted by Patlani Style; or

  • return/refund is otherwise required by applicable law.

Availability and final acceptance of customization requests remain subject to confirmation by Patlani Style.

36. INTELLECTUAL PROPERTY

Unless otherwise indicated, the Website and its original content are owned by or licensed to Patlani Style.

This includes, where applicable:

  • Patlani Style name and branding;

  • logos;

  • product photographs;

  • model photographs;

  • videos;

  • Website graphics;

  • banners;

  • text;

  • product descriptions;

  • design elements;

  • catalogues;

  • icons;

  • layouts;

  • software;

  • Website presentation.

These materials may be protected by copyright, trademark and other intellectual property laws.

37. TRADEMARKS

The trademarks, logos, trade names and service marks displayed on the Website belong to Patlani Style or their respective owners.

Nothing on the Website grants a User any licence or right to use such marks without the prior written permission of the relevant owner.

You may not use the Patlani Style name, logo or branding in a manner likely to create confusion regarding sponsorship, affiliation or authorization.

38. COPYRIGHT AND USE OF PRODUCT IMAGES

Product photographs, model images, catalogue images, graphics, videos, written descriptions and other original content belonging to Patlani Style may not be copied, reproduced, republished, modified, distributed or commercially exploited without prior written authorization.

Customers may save or print Website materials for personal, non-commercial shopping purposes.

Competitors, sellers, marketplaces or other commercial parties may not copy Patlani Style photographs or product content for their own listings without authorization.

39. DISCLAIMER

We endeavour to ensure that information provided on the Website is accurate and that Products are represented fairly.

However, except for warranties or rights that cannot legally be excluded, the Website and its content are provided on an ā€œas availableā€ basis.

We do not guarantee that:

  • Website access will always be uninterrupted;

  • all Website content will always be free of technical errors;

  • every Product will remain continuously available;

  • every user's device will display colours identically.

Nothing in these Terms excludes statutory warranties, guarantees or consumer rights that apply under Indian law.

40. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Patlani Style will not be liable for indirect, incidental, special or consequential losses arising solely from use of or inability to use the Website where such losses were not reasonably foreseeable.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, nothing in these Terms is intended to exclude liability arising from fraud, wilful misconduct or other liability that cannot lawfully be excluded.

Where liability can legally be limited, our liability in connection with a particular purchase will be determined in accordance with applicable law and the circumstances of the claim.

41. INDEMNITY

To the extent permitted by law, you agree to indemnify and hold Patlani Style and its authorized representatives harmless against claims, losses or reasonable costs arising directly from:

  • your unlawful use of the Website;

  • your material breach of these Terms;

  • your infringement of a third party's intellectual property rights;

  • fraudulent activity carried out by you;

  • content unlawfully submitted by you.

This provision does not apply to losses caused by Patlani Style's own unlawful conduct.

42. THIRD-PARTY PRODUCTS OR SERVICES

Where the Website makes available a Product or service supplied directly by an identified third party, additional terms of that third party may apply.

Patlani Style will not make representations regarding an independent third party beyond those for which Patlani Style is legally responsible.

Nothing in this section limits any responsibility imposed on Patlani Style by applicable consumer law.
